TERMS OF SALE

Satisfaction Guaranteed: If you disagree with any of our Terms of Sale, or find yourself dissatisfied with our tree stand for any reason, return it for a full refund within 30 days from the sale date, damage free, in the original box, with all videos, instruction, and manuals. Postage must be prepaid, COD’s not accepted.

Lifetime Limited Warranty: Our tree stands come with a Lifetime Limited Warranty against defects in material and workmanship of its structural body. Transfer of ownership voids this warranty. No other express or implied warranty is made, including, without limitation, warranty of merchantability and warranty of fitness for a particular purpose. This warranty is limited to the structural body of the tree stand and does not cover accessories, paint, seats, seat material, straps, bolts, nuts, pins, screws, ropes, belts, locks, chains, cords, caps, inserts, sleeves, triggers, springs, alterations, or modifications. This warranty does not cover any injury or damage to our tree stands due to normal wear and tear, metal deterioration from overexposure to the elements, abnormal use, misuse, abuse, or neglect. This warranty does not include or cover any injury or damage to our tree stands due to its use, application, assembly, installation, or maintenance contrary to our instructions, warnings, and safety rules.

Return Policy: If our tree stand is damaged or has missing items, phone us at 1-800-amacker or e-mail us, provide us with your name and order number, and we will take care of replacing the damaged or missing piece(s).

Shipping Policy: We do not charge you until we are ready to ship. If the merchandise is in stock, it will be shipped within seven (7) days and you will be charged on the day of shipment. If, after taking your order, we cannot fill your order within seven days due to inventory shortage, manufacturing limitations, or otherwise, we will place your order on back order, and charge you only on the day of shipment. Please allow four (4) to six (6) weeks for delivery of all back orders. You may cancel any order at any time prior to shipment. We ship everything based on UPS rates, so please provide us with a physical address, not a post office box. Shipping and handling charges are added to the price of the merchandise ordered.

Payment Policy: For credit card transactions, we accept Visa and Master Card. We accept Money Orders, but do not accept personal checks. Sales Tax: You will not be charged at sales tax if your order is shipped outside Louisiana. You will be charged a sales tax at the rate of 8.5% if your order is shipped within Louisiana.

Limitation of Liability: TO THE EXTENT PERMITTED BY APPLICABLE LAW, KEEPING OUR TREE STAND FOR MORE THAN 30 DAYS FROM THE SALE DATE SHALL CONSTITUTE AND BE DEEMED AN ACT OF ACCEPTANCE BY YOU OF THE ABOVE TERMS OF SALE AND SHALL CONSTITUTE AND BE DEEMED AN ACKNOWLEDGEMENT BY YOU THAT YOU INTEND TO AND WILL USE OUR TREE STAND IN STRICT ACCORDANCE WITH OUR INSTRUCTIONS, WARNINGS, AND SAFETY RULES AND SUBJECT TO THE FOLLOWING BINDING COVENANTS: 1) IT IS UNDERSTOOD AND AGREED THAT THE LIABILITY OF TREE-TEC TREESTANDS LLC. IS LIMITED IN CONTRACT TO THE COST OF REPAIR OR REPLACEMENT OF THE STRUCTURAL BODY OF OUR TREE STAND; 2) IT IS UNDERSTOOD AND AGREED THAT TREE -TEC TREESTANDS LLC., SHALL NOT BE LIABLE IN WARRANTY, CONTRACT, TORT, DELICT, OR ANY OTHER LEGAL THEORY TO COMPENSATE YOU FOR ANY INDIRECT, COMPENSATORY, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE DAMAGES, LOST PROFITS, BUSINESS INTERRUPTION DAMAGES, OR ANY OTHER LOSS OR INJURY TO PERSON OR PROPERTY RESULTING FROM FALLING FROM OR USING OUR TREE STAND; 3) IT IS UNDERSTOOD AND AGREED THAT (A) ANY LEGAL PROCEEDING ARISING OUT OF OR RELATING TO YOUR PURCHASE AND USE OF OUR TREE STAND SHALL BE INSTITUTED IN A STATE COURT SITTING IN THE PARISH OF RICHLAND, STATE OF LOUISIANA, UNITED STATED OF AMERICA, (B) ANY PRESENT OR FUTURE OBJECTION TO THE SELECTION OF THIS VENUE AND JURISDICTION IS HEREBY WAIVED; (C) ANY SUCH PROCEEDING MUST COMMENCED WITHIN ONE (1) YEAR AFTER THE CLAIM ARISES; AND (D) ALL OF THESE COVENANTS SHALL BE BINDING ON YOUR HEIRS, REPRESENTATIVES, SUCCESSORS, AND/OR ASSIGNS.
